Sort of. Fielder makes one-of-a-kind shows and movies by putting non-actors in very unusual situations surrounded by improv actors and then weaving their genuine words and actions into the narrative he wants to tell. People talking about the shows get confused only because the primary improv actor is him, playing a fictionalized version of himself, and he almost always plays that character in public appearances.
What makes the documentary so interesting is that the "real person" in this case is walking into the whole situation open-eyed about who Nathan is and what he does. What narrative does he plan to create given that situation? How successful will he be going up against her desire to tell her own story the way she wants it to be understood?

Why can't the flood of games be unlocked by people like FC who were already artists but will now be able to produce the passion projects that were stuck behind technical obstacles before?

There are two purposes of the justice system, vengeance / recourse for victims and protection for wider society. Clancy’s ex husband clearly forgives her for the murder and has supported her innocence in this trial. He is the only surviving injured party, other than the grandparents of the child, who also seemingly support her.
You've conveniently swept the primary victims under the rug. The state prosecutor exists partly to pursue justice on behalf of those that can't seek it for themselves. By your logic if their parents had been dead and she and her husband had both decided to kill their kids, there would be no reason to pursue justice at all.
The Greeks took slaves during their conquests and some of the unmarried female slaves became their concubines. Even though the modern world might describe both situations as rape, the Greeks would have sharply distinguished this from e.g. randomly grabbing a fleeing woman and forcibly having sex with her during the sack of Troy. It's possible that the latter was also treated as unobjectionable but your example doesn't prove it.
