Does placing a disclaimer before a show give you unlimited ability to then defame a person? Yes I am talking about Law and Order. And specifically the episode that aired last night “Facade”. Airing March 21, 2024.

The first 45 minutes or so fairly accurately portray the case of Daniel Perry who using a chokehold caused the death of Jordan Neely a homeless man who frightened passengers on a NYC subway.

Spoilers now so watch the episode or just read. The last 15 minutes show that he’s every leftist fantasy of what a white male really is. Turns out while doing the chokehold he said “blood and dirt” an obvious reference to Nazis and “blood and soil”. Furthermore the gym he goes to is ran by an undercover cop investigating white supremacists. He’s actually a full fledged Nazi collecting weapons to plan another very violent January 6. Non of this can be presented at trial because the white supremacists investigation is more important than convicting him at trial of murder.

Where am I going with this? This feels like defamation to me. There is no evidence that the real life Daniel Perry has any ties to actual Nazis.

I completely think art needs to have an ability to show real events. And I liked Law and Order back in the day. But there is a real life Daniel Perry and if I loosely followed the news I would 100% know the episode is referring to him. They followed the facts in the case accurately for 45 min. The last 15 min he is a terrorist Nazi. I would assume the last 15 min are referencing something in his background and he has some ties to real Nazis.

Without ruining the entire genre and making it impossible to do this feels like defamation to me. A midtwit would be under the impression it’s about him and he’s a real Nazi. But the real Daniel Perry is not a Nazi.

This leads to two questions for me. The lawyers can comment on the actual legal line here. The non-lawyers can discuss whether he’s damaged any differentially than if CNN just ran a bunch of made up stuff he was a Nazi. He’s a real private person and I think I can fairly say a lot of people would watch the episode and assume he has real Nazi ties.

There is one more element of art depicting reality. The FBI has instigated and put under covers in against normie Republicans and Pro-Life people on the grounds they are a national security threat but they probably aren’t in those cases full fledged terrorist.

If I were Daniel Perry I would try to sue. I feel like his reputation was damaged and he has real damages but not a lawyer to know the legal lines and I would assume NBC has lawyers but I still feel like he has a real reputational damage. Plus he’s going on trial and a juror who saw the episode would now think he has undisclosed nazi ties.

There is probably some who is the bad person thing here. In their fictional depictions from episodes 20 years ago I probably didn’t care when they added some negative stuff to a black character etc. But now that white people are bad I get upset when they add he was a Nazi about to commit 1/6 or 9/11 to their fictional portrayal of real events.

In summary his obvious fictional portrayal of his actions added a whole he’s a real Nazi plot line but they began the episode with a disclaimer it’s fictional.

Edit: I would be curious if anyone else watched the episode. Or if everyone is assuming I am appropriately representing the episode as they portrayed him as a “full-fledged nazi with a desire to kill black people” as accurate. And that exaggeration is expected now.

The right has an easy answer to this. The differences are entirely genetic. Low IQ, high criminality, highly prone to violence. There are no such things as “historical roots”. The problem with CRT is it then inflames racial differences and also proposes solutions that only makes things worse. For example it tries to solve genetic differences with social programs like affirmative action. Which eliminates the meritocracy but doesn’t solve the underlying differences.

Hanania also is a hardcore HBD but has stated fairly directly that you really can’t make those arguments in public. Instead he uses dog whistles now. Like arguing for the meritocracy because he views that as a winning political strategy while using his more direct logic for those positions is a failing political strategy. Arguing against affirmative action is a failure of a policy because IQ gaps can’t be fixed by going to Harvard is a losing strategy. Arguing for a meritocracy because Asians are on the wrong end of the affirmative action stick is a winning a political strategy.

Looks performative for now.

I’ve seen reports Iran gave the US flight paths for prior attacks to make sure everything was shot down.

The funny thing to me is there is some Air Force pilot somewhere whose highlight of his career is shooting down missiles the enemy gave him intel on just begging for someone to fuck up and give him a real mission like engaging some Iranian pilots and bombing a nuclear base.

The administration didn’t pick today for a trans religion holiday but it was assigned by trans religion.

Flying the trans flag during pride month at the Vatican Embassy was in my opinion far more disrespectful than what they did today which was a no-win situation for the politicians. That was truly disrespectful and obviously they would not try doing something like that in Saudi Arabia.

I can’t really describe trans/pride as anything other than a religion and since Scott describes it that way it feels like an acceptable view here. The politicians are just in a hard spot where they have two religions claiming the same day and the two religions both hate each other.

Edit: Lists of pride/trans related days some guy compiled on twitter. Significantly increasing my priors to spite. If they have this many holidays it’s a lot easier to not celebrate one of them when it’s another groups main holiday.

It doesn’t seem very fair to call WN as “brainwashing” or “propaganda”. A lot of their ideas seem very truthful to me. It’s probably impractical to make the US Sweden today, but a society like that with low crime and a far larger percent of their population being able to function in the modern world and therefore a higher trust society and a larger capability for a welfare state feels truthy to me. It’s not like they are just making stuff which brainwashing or propaganda seems to apply to me.

It’s definitely an honest debate on whether the US should move in a white nationalist direction (limit immigration, promote western civ, meritocracy, expect minorities to live by white standards, etc). And very honest for Europe to turn anti-immigrant so they do not develop similar problems as the USA.

More likely than not at this point though Sotomayor is who she is. I think the left could make a strong case for replacing her on her merits alone and not her age. If you have 3 SC justices I don’t think you can claim she is one of your top 3 liberal legal minds. I think it’s mostly a myth that most of the ME is against them. It feels to me like they are now just a chip in geopolitical games. The Saudis supposedly helped with air defense yesterday. A good econ piece for a good researcher would be to figure out why the costs of construction increased so much between 2019 to 2024. It seems like Texas could atleast print 3k sq ft at 500-600k new back then. With then older 3k sq ft homes going for 400k.

I have no idea why “the majority of whites are against” even means anything. Many things that eventually become accepted by society were unpopular at one point. Once upon a time I believed in Santa Claus.

I consider myself a white nationalist at least adjacent. I’m against killing Jews. I’m pro-English style colonization as a great good. I’m pro-police. I’m pro-western values and civilization as better. I think ethnostates often have a lot of beneficial features.

I am in Argentina now for a bit. And being here makes me more racists. Salaries are down like 20% in a few months in real terms and farther away from where I am at I am fairly certain there is real poverty. Yet things feel chill and feel safe. I see far fewer cops than I would in any major city in the states. In the states I have had lunch with literal army vehicles and national guard on the street corners. It keeps making me think is this what society would be like in a 100% European ancestry country.

Compared to the Reddit debates and how the SC would prevent this as a non-lawyer I thought the opinion was fairly basic and simple. It seems to me that they just declared it a Feds power in Federal elections and the States don’t get a say. Personally, I did come to a belief that it was self-executing.

I think they avoided really touching on all the novel legal theories both ways going around on Reddit or twitter.

It came down to what I believe was one of my original views that letting States have any say in declaring someone an insurrectionists would be a complete clusterfuck and basically turn into state legislatures electing Presidents. Therefore they declared it a federal power.

I would call this pragmatic versus legally correct in my opinion. They avoided 100 page treatise on whether the President is an office holder.

The city where every house has the ugliest siding I’ve ever seen yet people keep using the same siding. I grew up there so I can make it fun of it. When I go back I notice how much of the city just had awful curb appeal compared to the rest of America. Maybe it just sticks out more being a hill town.

The big culture war angle here is your insistent that the poors be allowed a space in the good communities and I get the sense you think that will fix the poors. I’ve come to the belief it’s better to be separate and a lot of American cities have suffered because they could not do that. Leading to rational middle and upper middle class leaving for the suburbs and less crime and more control over schooling. If we just kept the poors from the city America would have higher productivity growth.

There are many reasons why Pittsburgh has had a rebound. One reason is not getting a huge Great Migration. The other reason is the topography leading to isolated communities which meant many areas could feel perfectly safe. As someone whose lived in Chicago for a long time we frequently would look at the news and see 10 shots fired a few blocks away at 4 am. Why would anyone want to live like that unless you were forced to. Sure you probably won’t catch a stray bullet (but you might as we literally have a case like a dead UC student on the EL catching a bullet). Life really is a lot better when you do not interact with the forces of ghettoization.

Also worth mentioning that a big reason Pittsburgh had appeal is all of the money Carnegie left to build up cultural institutions.

The sports teams are interesting. The big thing is they have won more than a city like Pittsburgh should win. The city not being in a big other cultural world like the coast means a rabid fan base. The diaspora means Pittsburgh fans are everywhere.

At the end of the day AC means that Pittsburgh will never be as significant as it once was. The existing infrastructure and cultural heritage will keep a lot of people there.

That is obviously the Latino versus black debate. It appears the IQ gaps are relative small but the criminality eventually seems to disappear in Hispanic populations but not black populations.

IMO without doing the whole debate again you are making a giant assumption the CIA purposefully tried to provoke Russia into war versus what I believe is a much simpler explanation that Ukraine just wanted to be richer. I think pushing Gazans into Egypt can definitely be morally justified. This war has been going on for 80 years and shows no evidence it will ever end. It can be debated but one can certainly take a view that it’s continuance is primarily the responsibility of Palestinians themselves. A final solution to just end the war but forcible removal can be justified on those grounds. Israel has no moral obligation to continue to support people who are basically a death cult against Israel’s existence.

Any point before say 1000 of the common era forcible removal of people was fine if you just wanted their land. I still don’t think we live in a time where a stronger power can’t be justified in getting rid of a weaker power that consistently makes war with them. I personally have no moral qualms of Israel pursuing a final solution to the Palestinian question at this point (not including death camps/mass executions etc).

The international community is likely doing a disservice to Palestinians. They are providing hope that diplomatic victory of some sort is attainable if the Israeli’s go too far. If you removed that hope they would seem to need to accept they need to change. But instead I guess they have some hope Israel gets cut-off and something something they kick all the Jews out of Israel.
